OneSurvey (“we” or “us”), provides and maintains this web site and one or more related tablet and mobile applications (collectively, the “Site”) to provide an internet-based subscription software service to registered users (the “Service”).

This privacy policy describes the types of personal and non-personal information collected by us and describes how we use such information and to whom and under what circumstances we may disclose it. By registering as a user of our Services, or by accessing and using the Site or the Services, you agree to the collection, use and disclosure of your information as described in this privacy policy.

Information We Collect

a) Information Provided by You. We collect personal and business information that you provide us through the Site or the Services, or through other means such as email or online interactive forums. The information we collect from you will generally include your name, email address, address, phone number, company name, job title, photos, and information about your company, your company’s clients or potential clients, or other business associates.

When inviting other persons or businesses to view the content you have provided to the Service, you will share their names and email addresses with us as well. The information you provide may also include certain preferences that may be used to enhance your user experience, such as your preferences regarding products, services, technologies and manufacturers.

When you register as a user and pay for the Services, you will provide us with your billing name and address, your credit card number and expiration date, and any other information required to process your payments. You can choose not to provide us with certain personal and company information, but then you may not be able to gain access to or full value of the features and benefits of our Site or Services.

b) Automatic Collection of Information. Like many Web sites and mobile applications, we automatically track certain information about you as you use our Site and Services to help us manage our systems and deliver optimal user experience. This information may include, your IP address, the URLs and web pages you’ve visited along with frequency and duration of the visits, your geographic location, information accessed, and your browser type, operating system or mobile device information.

Use of Cookies and Similar Technologies

We might use “cookies” and other similar technologies to collect visitor information. This allows us to measure and improve the performance of our Site and Service and provide you with a more personal, interactive user experience. A cookie is a small data file that certain web sites and mobile apps write to your hard drive when you visit the site or use the app. A cookie file can contain various types of information, such as a user ID that the site or app uses to track the pages you've visited or the actions you've taken. A cookie can allow us to track the pages and features you access, and your usage patterns, and other information relevant to enhancing your user experience and delivery of our Services.

Use of Information

We will use the personal and business information you provide and the information we receive from your use of the Site and Services to provide products and services to you, enhance your user experience, to communicate with you and to provide customer support.

We also use information provided to us to improve our web site and software applications and platform, to develop new products and services, and to communicate with you about new and existing products, services and special offers unless and until you opt out of receiving such communications.

As a part of the Service, you may choose to share specific content with current or prospective customers or business partners through OneSurvey App for the purposes of communicating project details and other project related information.

Except as disclosed in this privacy policy, we do not disclose information about your individual visits to our Site or use of Services, or personal information that you provide, such as your name, address, e-mail address, telephone number, credit card number, etc., to any outside parties, except when we believe the law requires it.

We will retain your information for as long as it is needed to provide you Services or for as long as your account is active, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements.

Information Sharing with Third Parties

In order to provide the Site and Services we share personal and business information with third parties to perform functions on our behalf. These third parties may be provided with access to your personal information and other information only as needed to perform their functions but may not use your personal information for any other purpose. We may disclose information about you and your company to third party service providers we use in our business, including those who host or operate the Site or Services, process payments and other financial transactions, analyze data, provide customer service, or manage email services.

We may also disclose your information to third parties if we believe it is necessary or appropriate to:

  • Comply with the law, legal process, or a request for cooperation by a government entity;
  • Prevent, investigate, detect, or prosecute criminal offenses or attacks on the Site or our network;
  • Protect the rights, reputation, property, safety or security of OneSurvey, our users, our business partners, or others; or

We work closely with businesses and companies that fall into several categories. We may disclose information to businesses and companies affiliated with OneSurvey. In addition, you will receive notice should your information be disclosed to an affiliate and will have an opportunity to opt-out of sharing your information by sending us a written notice identifying which communications you choose not to receive by writing us at the address listed in the “Opting-Out” section below.

From time to time we may also disclose information to selected companies with whom we may partner to provide you with goods, products and/or services that might be useful to you. In such circumstances, you will receive notice should your information be disclosed to those selected companies, and will have an opportunity to opt-out of sharing your information by sending us a written notice identifying which communications you choose not to receive by writing us at the address listed in the “Opting Out” section below.

With that in mind, we want you to understand that when you use a link to go from the Site to another web site, or use a third party mobile application, our privacy policy or any company's privacy policy is no longer in effect and you are subject to the privacy policy of that third party web site or mobile application which we do not control.

Every now and then, OneSurvey may be transferred to another entity, might merge or combine with another entity, or might divest a portion of its business or assets. Should such an event occur, OneSurvey may transfer personal information and other information we have collected to such entity. We will use reasonable efforts to try to require that the new entity follows this privacy policy or a similar privacy policy with respect to your personal information. If your personal information could be used contrary to this privacy policy, you will receive prior notice as well as the opportunity to opt out.

In addition, we may disclose information that does not identify you individually, such as aggregate web site usage data or demographic reports, or stripped data, to third parties.

Opting Out of Communications

If you have subscribed to or are otherwise receiving our email, and no longer want to receive such information in the future, you may opt out of receiving these emails by clicking the “unsubscribe” link at the bottom of those emails. Please allow ample time for us to process your request.

Please indicate clearly which of the following choices you wish to opt out of:

  • Disclosure of information to affiliates;
  • Disclosure of information to selected companies with whom we may partner;
  • Receiving information from OneSurvey about product updates and special offers;
  • Receiving information from affiliates about their products and services; and/or
  • Receiving information from selected companies about their products and services.

Since these lists are prepared well in advance of each offer, please allow sufficient time for your opt out request to be processed. Also note that opting out of information sharing or receipt of marketing communications does not apply to business communications, such as order status, Service-related updates, membership status, or other communications relating to your business relationship with us, the Site or the Services.

Authorized Third Parties

All information you provide when you are using the Site and Services, including registration information, survey data, project information and photos, and other user-generated content may be available to and shared with authorized third parties, such as, without limitation, the company that owns the project, other members of your company, the co-owner of the project, the subscriber that invited you to use the OneSurvey App for a particular project, third parties that you share a particular project with, etc. By entering such information and content into the Site or Services, you acknowledge that such data and information will be shared with authorized third parties, and may be used by such authorized third parties subject to the terms of your agreements with them.

Control of Your Information

You are responsible for maintaining the accuracy of the information you submit to us. You can access, update or remove information about you that you have provided to us when you registered with us by logging into your account and editing your account information. You are also able to remove content that you have posted using the Site or the Services. If you wish to delete your account you must contact us at the email address set forth in the “Contact Us” section below and request that your account be deleted. In some cases we may retain copies of your information and content if required by law or for legitimate business purposes.

If you are a resident of the European Union, you may ask that we provide you with a copy of the information we hold about you. You may ask us to provide your information to you in a structured, commonly used, machine-readable format, and you may ask us to provide your information to another controller. You may object to the processing of your personal data in some circumstances or request that we stop using your information. If you ask us to delete your personal data, please know that we may retain personal information as required or permitted by law and that our systems may take some time to process your request.

On-line Postings

Certain personally-identifiable information collected from users may be disclosed as a matter of course as a result of use of the Services or the Site. We may provide areas on our Site where you can post reviews, comments, and other information relating to our Site or Services. If you use these areas, other visitors or users of our Site may be able to see your reviews, comments, and other information. Please review our Terms of Use for further information. We have no control over how these users may use your information. We are not responsible for the personal information you choose to submit in these forums.

Third Party Sites

The Site may contain links to other web sites or mobile applications that we do not control and that have their own privacy policies. We are not responsible for the privacy practices of these other web sites or mobile applications. Once you leave our Site or Service, you are subject to the privacy policies of those other sites and applications. Please review the privacy policy on each site or application that you visit.

Security

We use reasonable administrative, physical and technical measures to safeguard personal information in our possession against loss, theft and unauthorized use, disclosure or modification. However, no method of transmitting or storing electronic data is ever completely secure, and we cannot guarantee that such information will never be accessed, used or released in a manner that is inconsistent with this policy.

You are responsible for maintaining the confidentiality of your user name and password. If you believe your password has been compromised, please contact us immediately at the email address below. You are also responsible for all activities that occur under your account. If you share your account information with others, they may be able to view, edit or delete your account information and content.

California Privacy Rights

California Civil Code Section 1798.83 permits users who are California residents and who have an existing business relationship with us to request certain information regarding the disclosure of personal information to third parties for direct marketing purposes during the preceding calendar year. To make such a request, please write to us at the email address set forth in the “Contact Us” section below. Please note that under California law, businesses are only required to respond to a customer request once during any calendar year.

Children

We are committed to protecting the privacy of children. The Site and Services are not designed for or directed to children under the age of 13, and we do not intentionally collect personal information from children under the age of 13. If we discover that we have inadvertently collected personal information from a child under the age of 13, we will promptly delete such information.

California’s “Do Not Track” Notice:

Changes and Updates to the Privacy Policy

We may change this privacy policy from time to time. If we decide to make a significant change to our privacy policy, we will post a notice on the homepage of the Site for a period of time after the change is made. If we make a material change in the manner in which we use your personal information, we will notify you by sending an e-mail to the e-mail address associated with your account, by posting a notice on the Site, or by any other reasonable method. If you object to any such changes, your sole recourse shall be to cease using the Site and the Services. Your continued use of the Site or Services following notice of any such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
